I chose to address these particular topics for a number of reasons. First, Nevada law has changed in recent years and grandparents may now Petition the Court for custody of their grandchildren. Prior to the change in law, this was not possible. It must be remembered that a Court will only grant custody to the grandparents if it is shown to be in the best interests of the child. Second, guardianship over a child can be gained when the parents are struggling. This often occurs in cases involving drug use, alcohol abuse, or other addiction-related issues. Third, a grandparent may Petition for visitation under limited circumstances. A parent’s denial of visitation will, however, be presumed valid. The grandparent must overcome this presumption in order to gain visitation.
