This is the first post in a series of articles which will provide Las Vegas residents with an overview of Nevada child custody laws. I am writing on this topic due to the fact that our state has aspects to its child custody framework which differ from those of many other states. These differences can lead to confusion, and unnecessary disputes, between parents. The goal of my coming articles is to provide information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of a family law attorney. If you or a loved one are in need of assistance then contact my office today to speak with a child custody lawyer.
I will be addressing several topics over my coming articles. Issues which I will discuss include:
- Nevada’s definition of child custody
- How the Court determines child custody
- How Nevada calculates child support
- When a parent may change child custody
- Your rights under a child custody order
There are multiple reasons why I have chosen to address these particular topics. First, Nevada approaches child custody differently from many other states. A parent in our state does not need to have the child fifty percent of the time to be considered as having “joint” custody. Second, our state is also different from some other states in that the parents are presumed to have joint custody when no order is in place. When issuing an order the Court will base its decision on what is in a child’s best interest. Third, the calculation of support will depend on whether or not parents have joint custody or if one parent has primary care of the child. Fourth, the Court will change custody when circumstances have changed and the modification will serve the best interest of the child. Finally, understanding how to enforce one’s rights under a custody order is crucial.
A key point I will make in each of these articles is that it is important to retain an attorney to assist you with any family law dispute. Such cases often involve complicated issues of fact and law and it is important that you navigate the legal system correctly. Having counsel helps to ensure that you are raising the correct issues with the Court and that your rights are fully protected.
