This article is being written to conclude and recap my discussion on understanding child custody laws in the state of Nevada. I considered it important to write on this topic as it is common for parents to be under a misunderstanding as to what rights they do and do not have. The goal of my recent articles has been to provide information which will help people to better understand their options. It has also been my goal to provide information which will assist with the selection of a family law attorney. I have addressed multiple topics over my recent articles. Issues which I have analyzed included:
- Nevada’s definitions relating to child custody
- How child custody is determined in Nevada
- How child support is calculated
- When parents may change custody
- The rights a parent has under a custody order
There are several reasons why I chose to address these particular topics. First, Nevada is like many other states in that it defines two types of custody. These are “legal” and “physical”.” Unlike many other states, however, parents do not have to have the child fifty percent of the time for physical custody to be considered “joint.” Second, when determining custody, the Court’s sole focus will be for the best interests of the child. The desires of a parent are not relevant to the determination. Third, the calculation of child support will be based on gross income, the custody arrangement, whether the parents have other children, and more. Fourth, parents may only change custody when circumstances have materially changed since the last custodial order. Finally, knowing the extent of one’s rights can help to prevent conflict with the other parent.
An important point I made in each of these articles is that one should contact an attorney as soon as possible if they are involved in a family law dispute. Engaging in a back and forth argument with your ex may have the result of hurting your case. By retaining counsel, you help to ensure that you are handling matters through the appropriate channels.
