Family law bindersThis is the first post in a series which will speak to the issue of whether Las Vegas residents should file for an uncontested divorce. I feel it necessary to write on this topic as some people in our state decide to take advantage of the uncontested process and, as time goes on, they realize it may have been a mistake to do so. The goal of my coming posts is to provide people with information which will help them to better understand their options. It is also my goal to provide information which will help people make an informed decision when the time comes to hire a family law attorney. If you have questions about your rights then contact my office today to speak with a lawyer.

I will be addressing several topics over my coming articles. Issues which I will analyze include:

  • Whether one’s case is a “good fit” for the uncontested divorce process
  • Why accepting an uncontested outcome, simply to get the matter over with, may be a mistake
  • Why an uncontested divorce is inappropriate for one who may quickly go back to Court
  • The costs of an uncontested divorce versus the benefits

These are important topics for Las Vegas spouses to understand. First, those with complicated personal situations may wish to litigate their situation. An example of this would be a couple who owns a business but cannot agree on the company’s value; such a value would need to be decided through litigation. Second, some people simply wish to finalize their case and move on with their life. While this is understandable, the fact of the matter is that one may later regret such a decision. Third, if you are not confident on your ability to agree with the other side, after your case is completed, then you may wish to file a contested case instead. Finally, giving up certain rights or benefits may not be worth the time and money saved by utilizing the uncontested process.

One point I cannot stress enough is that you should speak with an experienced family law attorney to determine if an uncontested divorce is in your best interests. Counsel will help you analyze your situation and will explain the pros and the cons of going through litigation or engaging in a settlement of the matter.
