This article is being written to conclude and recap my series on Nevada’s joint custody laws for Las Vegas parents. I felt it important to write on this topic as many people are unsure about their ability to obtain joint custody of their child. It was my goal in writing this series to provide information to help people understand the law relating to custody matters. It has also been my goal to provide information which will assist with the selection of a family law attorney. If you or someone you know is in need of assistance, please contact my office today to speak to a lawyer.
I addressed a number of topics in this series. Issues which I addressed include:
- Nevada’s presumption of joint child custody
- How child support is calculated in joint custody cases
- When a court will vary from the presumption of joint custody
- How joint custody impacts a parent who wishes to relocate out of state
I chose to address these topics for a number of reasons. First, the Court will begin each case with a presumption that joint custody is in the best interests of the children. Second, child support may still be ordered even if the parents have joint custody. The parent who earns more may be required to pay the parent who earns less due to the Court’s formula for determining support. Third, the Court will always consider whether joint custody is in the best interest of the child involved. If the Court finds that primary custody is in the child’s best interest, then the Court may deviate from the presumption. Lastly, relocation of one parent does impact a joint custody order. It is important to understand how a Court grants permission to a parent to relocate.
A point that I stressed throughout each article in this series is the need to retain an experienced family lawyer as soon as possible if you are involved in a custody dispute. If you seek primary custody, the Court will need to be shown why it should deviate from the shared parenting presumption. If you wish to change your custody order, it is important to understand what a Judge considers in such situations. If you do not provide the Court reasons why joint custody is beneficial, it is possible the Judge will rule in favor of keeping the “status quo” between the parties. As a Las Vegas child custody lawyer, I am experienced with the handling of such matters. I understand that this is an important time in your life and my office will make your case a priority.
