There are several reasons why I chose to address these particular topics. First Nevada law generally favors a parent who has primary custody of the child in move away cases. Such a parent simply needs to show that the move would benefit the child and would be in the best interest of the youth. This is different from a case where the parents have joint custody, as such parents would also need to show changed circumstances since the last custodial order. Second, the process of requesting relocation begins with the filing of a Motion. Third, if a parent has a justified reason to move immediately, then the Court may grant temporary permission to relocate. A hearing would be held at a later time to determine if the move should be made permanent. Finally, parents must also understand when the Court will deny a relocation request and the type of facts to raise in opposition.
