This is the next article in my discussion on the handling of agreed upon divorces in our state. My last article looked at the question of “how quick is a no fight Nevada divorce?” It is important to understand that, while the process may sometimes be completed within a week, there are many situations which can lead to delays. Retaining a family law attorney can help to ensure that the matter is handled correctly. In this article I will be continuing that discussion by stressing the importance of retaining counsel. If you are in need of assistance then contact my office today to speak with a lawyer.
The first reason to retain counsel for your case is that they can help to ensure that all issues are properly resolved during the divorce. It is not uncommon for individuals to make an error or omission in their Court filings which then leads to future problems. This may, for example, include failing to list an asset or a debt. In such a situation, the spouses may then disagree over who holds the asset or who is responsible for the debt after their divorce is completed. If the amounts involved are significant enough then the parties may need to return to Court to litigate the matter before the Judge. This will typically involve each side retaining an attorney and spending significant amounts on legal fees. Such time, money, and aggravation can potentially be saved by retaining counsel who will be charged with ensuring that everything is handled correctly.
A second reason to retain an attorney is that it can help to prevent delays in the case. If provisions of a proposed Divorce Decree are too vague, then the Court may well reject the Decree. Additionally, there are many legal notices and provisions which must be included in any Nevada divorce. Failing to include the necessary language in a Decree can also lead to a denial of the Court. Finally, even though the spouses agree on all issues, the Court may still take issue with the Decree if it believes it is unfair to one side, if it does not serve the best interest of any children, or if it somehow runs afoul of the law. Counsel will draft a proposed Decree in a way which considers these types of issues.
