This is the first post in a series which will discuss how an economic slowdown, or worse, a full-blown recession, can impact child custody proceedings in Las Vegas, Nevada. I feel it is necessary to write on this topic due to the fact that many are concerned about the state of today’s economy. This concern, if it comes to fruition, can dramatically impact a parent’s legal situation. The goal of my coming articles is to provide information which will help parents understand how economic conditions impact their situation. It is also my goal to provide information which will assist with the selection of a family law attorney. If you or a loved one are in need of assistance then contact my office today to speak with a lawyer.
I will be addressing several topics over my coming articles. The issues which I will analyze include:
- How a recession can impact child relocation requests
- The potential need for a child support modification
- How a change in working hours can lead to a custody modification
- The need for a parent to show that they are not “underemployed”
There are several reasons why I have chosen to address these issues. First, if a parent loses their job due to an economic downturn then they may be required to seek employment elsewhere. This can lead to the need to request that they be allowed to move out of state with the child. Second, if a parent’s income goes down, due to no fault of their own, then they should immediately seek a modification of their support. Third, if your current custody arrangement is based on your work schedule, and that schedule changes, then it may be necessary to seek a custody/visitation modification. Finally, if a parent is found to be “underemployed” then they may be required to pay child support that is disproportionate to their actual income.
One point I cannot stress enough is that you should contact an experienced family law attorney immediately if you or a loved one are suffering an economic hardship. By speaking with counsel immediately, you help to ensure that a relatively minor problem does not develop into a full blown legal dispute.
