Parents with teenage childrenThis is the first post in a series which will discuss the possibility of a Las Vegas parent gaining primary custody of their child or children. I am writing on this topic due to the fact that many are unaware of the fact that Nevada is a state which presumes that parents should share joint custody of their kids. There are situations, however, in which a Clark County Family Court Judge will grant primary custody to one of the parents. The goal of my coming articles is to provide information which will help people to fully understand their options. It is also my goal to provide information which will help people make an informed decision when they are selecting a family law attorney. I will be addressing multiple topics over my coming articles. Issues which I will analyze include:

  • How the Court makes a child custody determination
  • Situations in which the Court will award one parent primary custody
  • The need to immediately initiate Court proceedings
  • The fact that Nevada does not favor one parent, over another, on the basis of gender

There are several reasons why it is important to understand these topics. First, the Court will begin each case with the presumption that custody should be shared. A Judge will only vary from this presumption if doing so would be in the best interests of the child. Second, there are many situations in which the Court will find that primary custody is in the child’s best interests. These situations can include extreme instances, such as drug use by a parent, or when logistics, such as distance between the parents, makes joint custody impractical. Third, if you believe that a situation exists, which justifies primary custody, then you should take immediate action. Failing to do so can lead the Judge to believe that the status quo is an acceptable situation. Finally, many err in thinking that Nevada offers a preference to the mother. This is not the case.

One point I cannot stress enough is that you should contact a Las Vegas child custody lawyer immediately if you wish to gain primary custody. Litigating such matters can be highly complicated and by retaining experienced counsel you help to ensure that your matter will be handled correctly.
