This is the first post in a series which will discuss the possibility of a Las Vegas parent gaining primary custody of their child or children. I am writing on this topic due to the fact that many are unaware of the fact that Nevada is a state which presumes that parents should share joint custody of their kids. There are several reasons why it is important to understand these topics. First, the Court will begin each case with the presumption that custody should be shared. A Judge will only vary from this presumption if doing so would be in the best interests of the child. Second, there are many situations in which the Court will find that primary custody is in the child’s best interests. These situations can include extreme instances, such as drug use by a parent, or when logistics, such as distance between the parents, makes joint custody impractical. Third, if you believe that a situation exists, which justifies primary custody, then you should take immediate action. Failing to do so can lead the Judge to believe that the status quo is an acceptable situation. Finally, many err in thinking that Nevada offers a preference to the mother. This is not the case.
