This article is being written to begin a discussion on the question of what happens at the first child custody hearing in a Las Vegas, Nevada family law case. I am writing on this topic due to the fact that, for obvious reasons, people typically do not know what to expect in a family law case. This can result in unnecessary fighting on the part of parents and can be detrimental to the best interests of a child. I am writing on this topic, therefore, with the goal of providing information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of an attorney. If you are in need of assistance then contact my office today to speak with a lawyer.
I will be addressing a number of topics over my coming articles. Issues which I will be analyzing include the following:
- Attending a hearing on a Motion for Temporary Orders
- What to expect if paternity has not been established
- What to expect if paternity has been established, but the parties are unmarried
- What to expect if the parties are married
- What to expect after the initial hearing
There are several reasons why I have chosen to address these particular topics. First, many people are unaware of the fact that Courts will often enter a temporary order, regarding custody, very early in the process. Understanding the process of obtaining such an order is important. Second, the process will look very different if paternity has not yet been determined. A paternity test will be ordered before the Court is willing to issue any rulings. Third, if the parties are unmarried then obtaining an initial order is important so that a sense of structure may be had. Fourth, if the parties are married then there will be additional issues, such as the possession of property, which will also be discussed at the initial hearing. Finally, it is important to know what to expect after the initial hearing or else parents may find themselves back in Court.
A key point I will be making in each of these articles is that parents should retain an attorney immediately if they are involved in a family law dispute. Retaining counsel helps to ensure that the law is being followed and can greatly reduce bickering between the parties. This, in turn, can help the situation to get to a better place sooner rather than later. I am a Las Vegas child custody lawyer who practices solely in the area of family law.
