There are several reasons why I have chosen to address these topics. First, you can only file for divorce in our state if you or your spouse has met the residency requirements. To establish residency, either spouse must have lived in the state for at least six weeks. Second, nonresidents can move to Nevada with the sole intention of filing for divorce six weeks later. However, this does have potential drawbacks, such as the court may not be able to exercise personal jurisdiction over the other spouse. Third, a Nevada divorce can easily be handled remotely. The only issue is that if there must be a trial, both spouses will need to attend in person. Finally, the filing of a divorce in Nevada will be very straightforward for the resident spouse. It may just be difficult for the nonresident spouse to attend a trial if necessary.
