This article is being written to conclude and recap my series on options for Las Vegas, Nevada residents who need to enforce the terms of a Divorce Decree. I considered it important to write on this topic as, unfortunately, many divorcees fail to meet their obligations after a case has been completed. This can leave the other spouse in a bad financial situation and with damaged credit. I wrote on this topic, therefore, to provide information which can help people to better understand their situation. It has also been my goal to provide information which will assist with the selection of an attorney. If you or a loved one need assistance then contact my office today to speak with a lawyer.
I addressed a number of topics over my recent articles. Issues which I analyzed included the following:
- Ways for a spouse to enforce a Decree of Divorce
- Making your spouse remove your name from debts
- Forcing a post-divorce asset sale
- The non-payment of alimony
- Dividing retirement assets after a divorce
There were several reasons why I covered these particular topics. First, while a primary option for enforcement is to seek a contempt order, disputes can often be resolved without court intervention. Second, if a spouse does not take required steps to remove your name from debts then the Judge may hold them in contempt and/or force the sale of assets. Third, post-divorce asset sales may be necessary to satisfy payments owed under the Decree. Fourth, a former spouse can face potential jail time for the non-payment of spousal support. Finally, if a spouse does not do what is necessary to divide retirement assets then a) they may be held in contempt and b) they may face consequences for losses incurred as a result.
A key point I made throughout this series is that one should take immediate action if their spouse is not living up to the terms of the Divorce Decree. It is important to take action immediately as you only have a limited amount of time in which you may enforce your rights. Moreover, simply engaging in a back and forth argument with your ex is likely to only increase stress without solving the actual problem.
