Divorce DecreeThis will be the first article in a series on enforcing a divorce decree in Las Vegas, Nevada. This is an important topic to address as parties often believe their case is “over” once their divorce is finalized. These ex-spouses can face difficulties, however, with getting the other side to live up to their end of the Court’s orders. Understanding the options for enforcement can be important to ensuring that one’s post-divorce life goes as smoothly as possible. I am writing this series, therefore, with the goal of providing information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of an attorney. If you are in need of assistance then contact my office today to speak with a family law lawyer.

I will be addressing a number of topics over my coming articles. Issues which I will analyze include the following:

  • Options for enforcing a divorce decree
  • Ensuring the other spouse removes your name from any debts
  • Forcing the sale of assets
  • Dealing with the non-payment of spousal support
  • Issues surrounding the division of retirement assets

I have chosen to address these particular topics for several reasons. First, if the matter cannot be resolved amicably then it may be necessary to initiate contempt proceedings. One only has six years, however, to initiate such proceedings. Second, if the spouse fails to remove your name from debts or timely sell assets then the Court may well hold them in contempt. Third, if a party is failing to pay their spousal support then the Court may order jail time and the money will still be owed upon the offending party’s release. Finally, while issues surrounding retirement assets should typically be straightforward, spouses sometimes attempt to delay matters.

If your former spouse is refusing to follow the terms of your divorce decree then it is important that you take immediate action. Waiting to initiate contempt proceedings can result in the Court finding that the matter is not urgent. As an experienced Las Vegas divorce lawyer, I am able to assist with such matters. If you or a loved one are in need of assistance then contact us online or by telephone to schedule an initial consultation. I look forward to speaking with you.
